Your privacy is very important to us. We understand and share your concern about privacy, and we ask that you please read this Privacy Policy.

• ProfitStreams LLC (“ProfitStreams”) provides a variety of services (“Services”) to visitors on the ProfitStreams websites (individually, the “Site”, or collectively “Sites”). Our visitors (“Visitors” may include the general public, guests (“Guests”) of our customers (“Subscribers” of ProfitStreams), dealers who support our Subscribers (“Dealers”) or prospective Guests, Subscribers or Dealers.
• Our Services provide a variety of information, resources, data and other benefits to our Visitors. Our Services also allow our Subscribers to serve their Guests, based on information provided by Guests directly from website input or from actions of the Guest.
• As a Visitor of one of our Sites, or one of our Subscribers’ websites, you have a choice in how much personal information you would like to share. As you will see below, some general information about your visit may be captured along the way. You should review the opt in and opt out options provided in any Subscriber sites you visit, and change them if necessary to reflect your preferences.
• As a Guest, information about your interaction with our Subscriber may also be captured. This information is intended to enable our Subscribers to improve your guest experience.

If you visit our Sites and/or access the Services offered by us, we have procedures in place to protect your privacy.

ProfitStreams collects your IP address, which we use to help diagnose problems with our server, to administer our Sites, and to improve our Services. Your IP address also is used to gather broad demographic information that does not personally identify you.

In addition to the use of the information we may collect as described below, we may track your e-mail address and/or IP address and/or the sites that you access while you use our Services if (i) we are required to do so by law; (ii) we have reason to believe that you have violated the terms and conditions of the Terms of Use, which may be viewed here; (iii) you have caused or attempted to cause harm to us or the other users of our Sites; and/or (iv) you voluntarily provide us with personal information (as described below).

Multiple types of information may be collected when you visit our Sites and/or utilize our Services:

Personal and Company Information. Personal information, such as name, address, telephone number, e-mail address, credit card numbers, or credit information, is only collected by us if you voluntarily submit it to us or post it on our Sites. For example, if you voluntarily register with us on our [registration site], we will receive the registration information that you submit so that we can better ensure that you are receiving the information or Services that you requested.

Aggregate Information. Aggregate information and automatically collected non-identifying statistics, such as information about how many visitors log on to the Sites, may be collected. ProfitStreams uses this information to measure the use of our Sites, to improve the content of our Sites, and to provide our users with the best possible services. Information which we may automatically gather and store about your visit includes the IP address from which you access our Sites; the name of the domain from which you access the Internet; the type of browser and operating system used to access our Sites; the date and time you access our Sites; the pages, files, documents and links that you visit; and the Internet address of the website from which you linked to this Sites. This information is stored and used in the aggregate only. ProfitStreams may, from time to time, make non-personal aggregate data available to third parties and other users of our Services.

Subscriber Data. If you are a Subscriber to the Services, the data which you voluntarily enter into ProfitStreams’s administrative site which allows you to set up and utilize the Services (the “Subscriber Data”) is only collected by us if you voluntarily submit it to us or to one of our third-party providers. The Subscriber Data which you provide to ProfitStreams may be made available in and become part of the Services and will therefore become publically available to other users of the Services.

ProfitStreams reserves the right to use Subscriber Data to notify you of important announcements regarding the operation of the Services as well as other marketing related communications that might interest you. You will not have the option of opting out unless you terminate your Subscriber Master Services Agreement. If you are or become a paying customer of any of the Services, you agree that ProfitStreams can disclose the fact that you are a customer.

ProfitStreams is not responsible for providing your Guests with the applicable federal and state consumer privacy law disclosures and notices on portions of your website not delivered by ProfitStreams. By agreeing to the terms and conditions of the Subscriber Master Services Agreement, you agree that your website will feature a privacy policy, linked conspicuously from your website’s home page that: (a) discloses your privacy practices; (b) identifies the collection (via cookies and/or web beacons) and use of information gathered in connection with third-party services, including without limitation the Services and information described herein; and (c) contains a statement specifically disclosing that you collect personally identifiable information and transmit such information to third parties such as ProfitStreams, and which offers site visitors an opportunity to opt out (or opt in), if applicable law requires.

Guest Data. ProfitStreams may collect data, information and material, including Guest contact information (“Guest Data”) associated with Guests who have specifically accessed a Subscriber’s website or a ProfitStreams’ Service micro website within a Subscriber’s website (“Subscriber Website”) and/or have utilized one or more of the online applications linked to a Subscriber’s Website, or data that has been collected via interfaces to a Subscriber’s point of sale or other internal computer applications. We use this information to enhance and provide our Services and to better meet the needs and preferences of Subscribers’ Guests. We may also, from time to time, send information to registered Guests about system changes or new products that we think may be of interest to them. In addition, we may use standard Internet tools, such as web beacons, to track Guests’ use of Subscribers’ Websites and our Sites and Services so that we may customize our Sites, Services and Subscriber marketing to better suit Subscribers and Guests. ProfitStreams may, from time to time, make non-personal Guest Data in the aggregate available to third parties and other users of the Services.

ProfitStreams will share the Guest Data specified above with the Subscriber that owns the website from which Guest accessed the ProfitStreams Services. Subscribers cannot access information pertaining to Guests or Guest history from other non-affiliated Subscribers to the Services. However, Guests must understand that any Guest Data shared with ProfitStreams during Guest’s utilization of the Sites and/or Services may be used by the applicable Subscriber for its internal, lawful purposes. Additionally, a Subscriber may share Guest Data with other businesses under the same ownership or within the same legal entity/group.

In sum, you can visit our Sites without telling us who you are or revealing personal information about yourself. However, you can, if you choose, participate in additional secured applications available to Guests and Subscribers. For access to these applications, you are required to complete a registration form with. This form includes information such as name, address, phone number and e-mail address. We use this information to provide and enhance our Services, to better meet the needs and preferences of our users, Guests and Subscribers, and to enhance the security of our Sites. We may also, from time to time, send information to Guests and Subscribers about system changes or new Services that we think may be of interest.

Cookies
In addition to the information described above, we may also collect cookies. Cookies are small files of information that are stored on your computer’s hard drive by your web browser. The cookies we use do not contain any personal information. Most web browsers automatically accept cookies, but you can change the preferences of your browser so that it does not accept them. In order to use all the features of the Sites, we recommend that you accept cookies.

Personal Information
ProfitStreams does not rent, sell or share personal information (i.e., names, addresses, e-mail addresses or phone numbers as well as other non-public information that is associated with the Services) (“Personal Information”) about you with other people or non-affiliated companies except as specifically described in this Privacy Policy, to provide Services that you have requested, or under the following circumstances:

We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.

We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

We may share some or all of your Personal Information with companies under common control (“Affiliates”). In such case, we will require our Affiliates to honor this Privacy Policy. In the event ProfitStreams goes through a business transition such as a merger, acquisition by another company or a sale of all or a substantial portion of its assets, your Personal Information will likely be among the assets transferred. You acknowledge and consent that such transfers may occur, and that any acquirer of ProfitStreams or its assets may continue to use your Personal Information as set forth in this Privacy Policy.

Links to Other Sites
Our Services may provide advertisements and/or links to third-party external sites. The inclusion of any advertisement and/or link in connection with our Sites or the Services does not imply our endorsement of the external site company, its website or websites, or the products and services it promotes or sells. When you leave our Sites or a Subscriber Website to visit one of these linked sites, the only information transferred to the third party is the fact that you came from our Sites or the Subscriber Website.

ProfitStreams is not responsible or liable for the independent privacy policies of the Subscriber Websites or the third-party websites. You should consult the privacy policies at these other websites to determine how your information may be used.

Data Security
ProfitStreams is committed to online data security, and for that reason we take steps to make all information received from you online as secure as reasonably possible from unauthorized access and use. ProfitStreams’ secure server software uses industry-standard Secure Socket Layer (SSL) encryption technology. SSL encodes your personal information, including credit card number, name, and address, as it travels over the Internet so that all transactions are secure. Unauthorized access is prohibited and punishable under the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.

Children’s Privacy
We believe that protecting the privacy of children is especially important, and for that reason it is our intention to never collect or maintain information from children in connection with our Sites or the Services offered.

Your Consent
By using our Services, you consent to the collection and use of this information in the manner we describe herein.
Editing or Deleting Account Information
Content or other data that you may have provided to us and that is not contained within a Subscriber profile or through use of Services (such as posts that may appear within our forums, information you enter on blogs on our Sites, and/or tweet feeds) may continue to remain on our Sites at our discretion even though your profile is deleted. Please see our Terms of Use for more information.

Modifications
If we decide to change our Privacy Policy in whole or in part, we will post a notice on our Sites. Those changes will go into effect on the date indicated in the notice and will apply to all users of our Sites and Services.

No Guarantees
While this Privacy Policy states our standards for maintenance of data and we will make efforts to meet them, we are not in a position to guarantee these standards. There may be factors beyond our control that may result in disclosure of data. As a consequence, we disclaim any warranties or representations relating to maintenance or nondisclosure of data.
